1. Definitions
- “Client,” “You,” and “Your” refers to you, the person logging on this website and compliant to the Company’s terms and conditions.
- “The Company,” “Ourselves,” “We,” “Our,” and “Us” refers to Nexora Industry and Coating System.
- “Party,” “Parties,” or “Us” refers to both the Client and ourselves.
2. Use of Products and Technical Advice
- Application Standards: All industrial coating systems, primers, and finishes must be applied in accordance with Nexora’s official technical data sheets (TDS) and safety data sheets (SDS).
- Surface Preparation: The client is responsible for adequate surface preparation unless explicitly contracted application services are provided by Nexora. We assume no liability for coating failure resulting from improper substrate preparation, environmental conditions during application, or misuse.
- Samples and Color Matching: Color swatches and samples are representative approximations. Minor batch-to-batch variations can occur in industrial chemical formulations.
3. Orders, Pricing, and Payment
- Quotations: Quotations provided for custom coating projects or bulk industrial orders are valid for 30 days unless otherwise specified.
- Pricing: All prices are subject to change without notice, though confirmed orders will be invoiced at the agreed-upon rate.
- Payment Terms: Payment must be made in accordance with the terms stated on the official invoice. Late payments may incur interest charges at the maximum rate permitted by applicable law.
4. Shipping and Delivery
- Risk of Loss: Delivery terms (e.g., FOB, Ex-Works) will be defined per order. Risk of loss and title for products pass to you upon delivery to the carrier.
- Inspection: The client must inspect all shipments immediately upon receipt and report any damages, shortages, or discrepancies within 48 hours of delivery.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Nexora Industry and Coating System shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the products; (ii) any failure of performance or application defect not directly caused by manufacturing error. Our total liability for any claim arising out of or relating to these terms or our products shall not exceed the total amount paid by you for the specific product giving rise to the liability.
6. Governing Law
